12.1 You (authors) cannot post any draft versions, abstracts or abridgements of articles, case studies or any other work (including text, figures, tables, statistics and all other material) that you have submitted to our website or to us (by post, through our website, by email, directly to us or in any other way), on your own, your employer or any other third-party website. 12.2 However you (the authors) can post links on your own or your employer(s) website using the applicable URL of our website and refer to the article(s), case study(ies) and any other work your have submitted to us. 12.3 You (authors) cannot state or imply that you have any form of joint venture, pooling arrangement, licensing, partnership or any other formal business arrangement with us. 12.4 You (authors) cannot state or imply any kind of employer–employee relationship of any kind, between us and you. 12.5 In all cases to display our Trademarks and/or logo, you (authors) need a written permission. 12.6 You (authors) cannot store work that they have submitted to our website on a database or any other media accessible by any third party, with the exception of one copy that can be stored on a hard drive, CD/DVD or a removable personal storage device and used strictly for personal research, teaching and other non-commercial purposes only.
13. Joint authorship
13.1 In cases of joint authorship by two or more individuals, the you (joint authors) must, prior to submission, make all necessary arrangements, sign the applicable documents if any and obtain case by case the required permissions and consent, appointing as your representative the individual who will make the submission to us. 13.2 All co-writers thus agree that you have transferred all rights exclusively and entirely to the co-writer who will be making the submission to us. 14.1 This copyright transfer agreement is in relation to any and/or all material submitted to us through our website, by email, post or by any other way, including directly to us. 14.2 This copyright transfer agreement will be annulled if we do not publish (print, display on our website in any form, or in any other way communicate to the public) your work within twelve (12) months or 365 days from submission, starting the first Monday (00:01 UK time) after the day of submission. 14.3 This agreement is between us, our subsidiaries, successors and assigns and all authors of all materials submitted to us, including but not limited to text, graphs, tables, documents, statistics, and any other materials submitted by individuals or a group of individuals to us through our website, by email, post or in any other way, including directly to us. 14.4 The agreement is a civil legal document which controls and regulates the proprietary rights of the authors and the work that they submitted to us in any way, including but not limited to email, through our websites, by post, in person or in any other way. 14.5 Upon submission of any materials to us (through our website, by email, post or in any other way, including directly to us) the author(s) agree that these materials are automatically transferred to us exclusively and entirely, worldwide and in all languages. 14.6 The transfer includes all Copyrights, Commercial Rights and any other rights of all materials submitted with the exception of Patents rights for which author(s) retain the rights and we make no claim of ownership or demand for royalties in relations to Patents arising from materials submitted to us. 14.7 You the author(s) state and agree that from and/or upon submission all proprietary rights are transferred exclusively and entirely to us and agree to indemnify us against all third-party claims all over the world, including but not limited to any possible claims from co-author(s), claims arising as a result of a breach of Copyright, slander, loss of fame, loss of reputation, damage to Trade Marks, and any other loss or damages what so ever. 14.8 You the author(s) state declare and agree that this electronic Copyright Transfer Agreement has your full and irrefutable authorisation and that you have read, understood and agreed with this Copyright Transfer Agreement (and with the Terms and Conditions, Privacy Policy, Disclaimer, and Copyright and Permissions), which forms part of these Copyright and Permissions and is part of our Terms and Conditions. 14.9 You the author(s) state, declare and agree that no part of the work submitted has been developed in the course of employment of any kind, or if any part of the work submitted was developed in the course of employment, you the author(s) state, declare and agree that you have all Copyright, commercial rights and any other rights vested exclusively and entirely in you and agree to indemnify us again all third-party claims now and in the future. 14.10 You the author(s) state, declare and agree that no payment has been made by us to you, nor by you to us. 14.11 You the author(s) state declare and agree that you forego all royalties, remuneration, payments and/or any other benefits now and in the future in relation to all and/or any materials submitted to us in any way, with the exception of any prizes or awards that you may be awarded by us if your submission(s) is/are related to one of our competitions or any other promotional activities that we may organise from time to time. Any such prices and awards may be subject to additional Terms and Conditions. You agree that any such prizes and awards are not a contradiction with any of statements in these Copyright and Permissions and/or any part of our Terms and Conditions, and that they have no bearing in relation to the Copyright Transfer Agreement, which is valid and in full force even if the competition or any other promotional activity is cancelled, declared barren or in any other way and/or for any other reason, not implemented and/or accomplished, and associated prices and awards not given. 14.12 You the author(s) state, declare and agree that you have obtained all legal permissions and documents (in relation to the use of any materials that you have used to develop any work that you have submitted to us, which is not your and/or your co-author(s) property), and agree to indemnify us against all third-party claims all over the world, including but not limited to any possible claims from co-author(s), claims arising as a result of a breach of Copyright, slander, lost of fame, lost of reputation, damage to Trade Marks, loss of sales, goodwill or profits and any other loss or damages what so ever, whether or not we have been advised of such possibility. 14.13 You the author(s) state, declare and agree that you represent all and/or any co-author(s) and that you have their permission (including all legal documents if applicable) to transfer exclusively and entirely to us the worldwide and for all languages Copyrights, commercial and any other rights of all materials submitted with the exception of Patents rights for which you (and all co-author(s)) retain all rights; we make no claim of ownership or demand for any royalties in relations to any patents arising from any materials submitted to us. 14.14 You the author(s) state, declare and agree that all your contribution, including but not limited to all text (including articles, case studies, book reviews and any other written work), images, pictures, graphs, figures and statistics is voluntarily and as such you have no financial or any other benefit claims against this contribution or any claims arising in relation to it from us, our subsidiaries, successors and assigns, now and/or in the future. 14.15 You the author(s) state, declare and agree that your acceptance (without any hesitation) of these Copyright and Permissions and our Terms and Conditions and the submissions of any materials to us through any means, stand as your signature. 14.16 You the author(s) state declare and agree that: 14.16.1 You hereby assign to us, our subsidiaries, successors and assigns, exclusively and entirely all your rights, title and interest in relation to all materials submitted, including without limitation the copyright therein. 14.16.2 You hereby warrant and represent to us, our subsidiaries, successors and assigns, that all materials submitted are original work and have not been previous published in any form, are not currently under consideration for publication by any other media, do not infringe upon the Copyright or any other Intellectual or commercial rights of any kind belonging to another person or organisation and that you are the exclusive owner and/or legal representative of the rights herein conveyed to us, our subsidiaries, successors and assigns. 14.16.3 You hereby warrant and represent to us, our subsidiaries, successors and assigns, that the article does not infringe upon any Copyright or any other rights of any individual or organisation, does not contain infringing, defamatory or other unlawful material, and that you have obtained in writing or as the law demands the customary permission from each Copyright owner or his or her legal representatives or heirs whenever a passage is quoted and/or a table or illustration from Copyrighted material is used. 14.16.4 You hereby warrant and represent to us, our directors, employees, subsidiaries, successors and assigns, that any use of any third party materials in the work submitted by you is clearly stated and identified in the work submitted, and properly referenced and cited. 14.16.5 You hereby agree, warrant and represent to indemnify us, our directors, employees, subsidiaries, successors and assigns, for, and hold harmless from, any liability, loss, expense or damage occasioned with any claim or suit by a third party for copyright infringement or otherwise arising out of any breach of the foregoing warranties as a result of publishing or in connection to any other use of the materials submitted, now and in the future as aforesaid. 14.16.6 You warrant and represent that you understand and agree that we, our subsidiaries, successors and assigns, is under no obligation to make any kind of payment, provide other compensation or benefits what so ever, to you, any other co-author(s) or any other third party and that all material submitted are free from all claims. Therefore you [the author(s)] agree to be responsible now and in the future without limitation for any claims and payment arising in relation to all material that you have submitted to us. 14.16.7 You, the author(s) submitting the material(s) represent and warrant that you are authorised to execute this transfer of Copyright and all other rights, on behalf of all the authors and on behalf of all those who have contributed in any way in the development and creation of all work submitted. 14.16.8 You represent and warrant that you have transferred all rights exclusively and entirely (with the exception of Patents rights) to us, our subsidiaries, successors and assigns, and therefore have resigned from any payment, benefits, royalty claims or other compensations now and in the future. 14.16.9 You hereby state declare and agree that we reserve the right to organise competitions (promotional contests, marketing events, customer surveys), and other offers and/or activities, that may have benefits such as awards, prizes in money or other gifts or rewards. 15. Pictures and/or Images Copyright Transfer Agreement (Licence)
15.1 This Copyright Transfer Agreement (Licence) is in relation to any and/or all pictures and/or images submitted to us through our website, by email, post or in any other way, including directly to us. 15.2 Upon submission you grant to us (our subsidiaries, successors and assigns) a non-exclusive, unlimited, irrevocable, transferable, assignable, irreversible, worldwide and royalty-free licence for all pictures and/or images. 15.3 You state, declare and agree that all Copyright and any other proprietary rights are vested in you and therefore you have the right to grant us (our subsidiaries, successors and assigns) a non-exclusive, unlimited, irrevocable, transferable, assignable, irreversible, worldwide and royalty-free licence, and agree to indemnify us against all third-party claims all over the world, including but not limited to all claims arising as a result of a breach of Copyright, slander, loss of fame, loss of reputation, damage to Trade Marks, loss of profits and any other loss and/or damages what so ever. 15.4 You state, declare and agree that this electronic Copyright Transfer Agreement (Licence) has your full and irrefutable authorisation and that you have read, understood and agreed with this Copyright Transfer Agreement (and with the Terms and Conditions, Privacy Policy, Disclaimer, and Copyright and Permissions), which forms part of these Copyright and Permissions and is part of our Terms and Conditions. 15.5 You state, declare and agree that no payment has been made by us to you, nor by you to us. 15.6 You state, declare and agree that you forego all royalties, remuneration, payments and/or any other benefits now and in the future in relation to all and/or any pictures and/or images submitted to us in any way, what so ever. 15.7 In cases of share ownership, you state, declare and agree that you represent all co-author(s), other individual and/or organizations (than have any proprietary rights in relation to any of the pictures and/or images submitted) and that you have their permission (including all legal documents if applicable) to transfer a non-exclusive, unlimited, irrevocable, transferable, assignable, irreversible, worldwide and royalty-free licence to us. 15.8 You state, declare and agree that your acceptance of these Terms and Conditions and the submissions of any materials to us through any means, stand as your signature. 15.9 You hereby state, declare, agree, warrant and represent to us (our directors, employees, subsidiaries, successors and assigns), that all pictures and/or images submitted to us through our website, by email, post or by any other way, including directly to us, do not infringe upon any Copyright or any other rights of any individual or organisation, does not contain infringing, defamatory or other unlawful material, and that you have obtained in writing or as the law demands the customary permission from each Copyright owner or his or her legal representatives or heirs, for all instances that this is legally necessary. 15.10 You hereby state, declare, and agree to indemnify us (our directors, employees, subsidiaries, successors and assigns) for, and hold harmless from, any liability, loss, expense or damage occasioned with any claim or suit by a third party for Copyright infringement or otherwise arising out of any breach of the foregoing warranties as a result of publishing or in connection to any other use of any pictures and/or images submitted to us by you, in any way, including but not limited through our website, by email, post or directly to us. No payment of any kind is due to you, your employer or any other third party now or in the future what so ever and none can be claimed.
16. Application for Lay-member of our Editorial Team and Copyright Transfer Agreement
16.1 You may apply to join our editorial team by submitting the “Editors Form”, which can be accessed through our home page. 16.2 We will normally reply to you within one (1) month. If we currently have no vacancy or if your skills are currently already covered, we shall keep your application on file for a period of two (2) years and may contact you in the future. 16.3 Your contribution is voluntary and you agree that no payment has been made, will be made or can be claimed now or in the future, regarding any contribution that you will make as a member of our editorial team. 16.4 You attest and agree that all potential commercial rights and Copyrights of any contribution that you will make during your time as a member of our editorial team, for Anglohigher.com™ and/or AngloHigher® The Magazine of Global English Speaking Higher Education™ and/or any other website and/or publication of Panethnic Limited is exclusively and entirely the property of Panethnic Limited (owner of Anglohigher.com™ and AngloHigher® The Magazine of Global English Speaking Higher Education™), Panethnic Limited subsidiaries, successors and assigns, and therefore you have no claims of any kind and have resigned from all payments, benefits, royalty claims or other compensations now and in the future. 16.5 You state that you make no claim to any rights or payment whatsoever. You hereby state, declare, and agree to indemnify us, now and in the future as aforesaid. 17.15 You and your employer (including but not limited to your directors, employees, subsidiaries, successors and assigns) hereby state, declare, and agree to that we (including but not limited to our directors, employees, subsidiaries, successors and assigns) are under no obligation to make any kind of payment, provide other compensation or benefits what so ever, to you, your employer or any other third party, and that all material submitted are free from all claims. 17.16 You and your employer hereby state, declare, and agree that you transferred a non-exclusive, unlimited, irreversible, worldwide, irrevocable and royalty-free licence to us to use as we see fit all material, and therefore you and your employer have resigned from any payment, benefits, royalty claims or other compensations now and in the future. 17.17 You and your employer (including but not limited to your directors, employees, subsidiaries, successors and assigns) hereby state, declare, and agree to be responsible now and in the future without limitation for all claims, benefits, royalty and all other payments and compensations arising in relation to any material submitted to us by you, through our website, by email, post or in any other way, including directly to us.
